Payment Terms:
- A 50% deposit of the total price is required upon agreement, which is non-refundable.
- The remaining balance must be settled by NET-7 (7 days) on the specified due date which will be introduced once the first previews of your videos are sent out to the client.
- Failure to meet the payment deadline will result in a late fee of $100.00.
Delivery Of Final Product:
- Nowhere Media requires payment in full before final delivery of product to client, unless other arrangements have been entered into.
Revision Policy:
- Client is entitled to two round of revisions for the completed video project, free of charge, within reason. This includes minor adjustments to content, color grading, trimming, and other aspects of the video. Any additional revisions such as a change of song, completely different timeline change or other major changes requested by the Client will be subject to additional charges at Nowhere Media's revision rate (minimum fee charge of $50.00).
Raw Footage:
- The Customer may have Raw Footage transferred to their own supplied hard disk, or uploaded as required, the Customer must pay Nowhere Media an additional fee of $200.00 from 20GB to 100GB other sizes are by negotiation.
Disposal:
- Raw Footage, video files, audio files and edited video files will be retained for up to twelve (12) months only and will then be disposed of, archived, deleted or erased. If at the end of twelve (12) months Services have not been paid for, Nowhere Media reserves the right to dispose of all Raw Footage, video files, audio files, edited video files, recorded materials and finished works.
Usage Rights:
- The finished products provided are for personal or agreed-upon commercial use only.
- Editing of the video content, including the addition of filters or alternative music, is strictly prohibited without prior consent.
Social Media Posting:
- Clients are permitted to post the video content on social media platforms for promotional purposes.
- When posting the video, clients must collaborate or tag 'Nowhere Media' on said post.
- Any alteration to the video content that compromises the integrity of the original work is prohibited.
Ownership and Rights:
- NOWHERE MEDIA retains all intellectual property rights to the produced content until full payment is received.
- Upon full payment, clients gain non-exclusive rights to use the content as outlined in this agreement.
- NOWHERE MEDIA has the right to use any video content made for clients for promotional use within the parameters of NOWHERE MEDIA’s social accounts.
Cancellation Policy:
- Cancellations made after the commencement of work will result in forfeiture of the finished products.
- NOWHERE MEDIA reserves the right to cancel the project if the client fails to meet payment deadlines or breaches the terms of this agreement.
Amendments:
- NOWHERE MEDIA reserves the right to amend these terms and conditions at any time with prior notice to the client.
Venue Location Fees & Permissions:
- The Customer must obtain any necessary consent or permission and pay any fees that may apply for Nowhere Media to film at a particular venue, location or event.
Talent/Background persons/Staff:
- If the customer requires talent, staff, background persons or passers-by to be included in the production, then it is the responsibility of the customer to obtain the necessary permissions. Nowhere Media cannot be held liable for any prosecution from any person that appears without permission. If re-editing or shooting is required to remove such persons it shall be at the customers expense.
By proceeding with the payment and engagement of NOWHERE MEDIA's services, the client agrees to abide by the terms and conditions outlined above.
